However, U.S. District Judge Colleen McMahon ruled that the plaintiffs failed to demonstrate sufficient harm but left room for them to file an amended complaint.

Judge McMahon expressed skepticism about the outlets’ chances of establishing a “cognizable injury.” In her ruling, she noted, “The alleged injury for which Plaintiffs truly seek redress is not the exclusion of copyright management information, but rather the use of Plaintiffs’ articles to develop ChatGPT without compensation.” Her decision underscored a crucial distinction in copyright law, questioning whether the plaintiffs’ claims reached the legal threshold necessary to proceed.

The Basis of the Lawsuit

The lawsuit filed in February alleged that OpenAI used thousands of articles from Raw Story and AlterNet without permission to enhance its language models, including ChatGPT. Their response suggests that this legal battle may be far from over, setting the stage for an appeal or amended filing that could bring new insights to the evolving legal landscape surrounding AI and copyright.

The case, officially titled Raw Story Media v. OpenAI Inc., is currently docketed in the U.S. District Court for the Southern District of New York. This ruling will likely serve as a benchmark for other cases as the courts continue to grapple with AI’s reliance on copyrighted material.
